Intended Parents

Even though a Couple deeply wants to have a child, there are some requirements that have to be met in order to ensure the Child an adequate environment to favor a good development.
- 21-55 Years of Age
- Valid Passport for the entire surrogacy process (12 months)
- Background check from national police of country
- Have open travel arrangements for two trips to Kazakhstan or Kyrgyzstan within 12 months from when the process starts
- Living in an adequate home, to house a family with a room for the Child
- Be Willing to undergo a medical screening
- Have an understanding of the Surrogacy Process’ implications
- To complete all paperwork in full in a timely manner
- To respect the timeframe agreed with International Surrogacy Consulting.
- Do Not abuse alcohol, drugs or medication
- Live in a country where surrogacy is legal and/or recognized


Surrogacy Laws
Even though surrogacy is legal in Kazakhstan and Kyrgyzstan, the rules differ by country. Before deciding to pursue this extraordinary venture, the Intended Parents should make sure it is legally accepted in their country before investing time and money in the process. ISC has gathered some information to help Couples find out the laws applicable in their country because Surrogacy Laws differ by country.
Kazakhstan Legislation
You can find the Kazakhs law on Surrogacy in the “Law on Marriage and Family code” dated December 26, 2011 No. 518-IV, in Chapter 9; Surrogate motherhood and application of assisted reproductive methods and technologies, article 54-59.
The law sets up the framework on the rule of Surrogacy, the rights and obligations of all parties and the application of the Assisted Reproductive method.
Kyrgyz Legislation
Law on Reproductive Rights of Kyrgyz Republic Citizens, Laws of the Kyrgyz Republic of July 6, 2016 N 99, January 15, 2019 N 5 , Article 18 to 21
The Law allows for the use of surrogate mothers by persons who desire a child but cannot have one due to medical reasons. (Id. art. 18.1.) This method of reproduction requires a notarized contract. If the surrogate mother is married, the consent of her spouse is necessary. (Id. art. 18.2.) According to the Law, the surrogate mother must be between 20 and 40 years old, be mentally and physically healthy, have at least one biological child, and pass medical and genetic tests. (Id. art. 18.3.) Married couples who sign a contract for a surrogate motherhood bear all material costs associated with the surrogate mother’s pregnancy, labor, and postpartum period. (Id. art. 18.5.)
